Legal information
Terms and conditions of booking
These terms govern the booking of consultations, tests and procedures with InSurgical, whether you pay online or at the clinic. Please read them before paying: by booking, you accept them. They are a translation; if you need the Spanish version, it is available on this website.
In short
- You can reschedule or cancel consultations, tests, consumables and medicines at any time, without notice and at no cost: we refund everything you paid or apply it to a new date.
- You can reschedule or cancel a surgical procedure at no cost with at least 48 hours' notice.
- If you cancel a procedure with less than 48 hours' notice, or do not attend, only 10% of the surgical fee is retained; everything else is refunded in full.
- If the clinic cancels your appointment or procedure, we refund everything or give you a new date, as you choose.
- Refunds are made within 14 calendar days at most, to the same payment method.
1. Who provides the service
The provider is Iván Díaz Cuadrado, trading as InSurgical, Spanish tax ID (NIF) 47270320F, with address at Pg. de Sant Gervasi, 55, Centro Médico La Rotonda, 08022 Barcelona (Spain). He is a specialist in General and Digestive Surgery, registered with the Barcelona Medical Association (Col·legi Oficial de Metges de Barcelona) under no. 56029. Phone and WhatsApp: +34 639 301 352. Email: info@insurgical.es. Further legal details are in the legal notice (in Spanish).
2. Scope and acceptance
These terms apply to every service you book with InSurgical: online (on the booking page or through a payment link we send you), by phone, by WhatsApp or at the clinic. By making a payment or accepting a quote, you confirm that you have read and accepted them. Anything agreed in writing in a specific quote takes precedence over these general terms, provided it is not less favourable to you than the law allows.
The current terms are always published on this page, in Spanish, Catalan, English and Arabic. If you would like a paper or PDF copy, ask at the clinic or by email.
3. Services
- In-person consultation at the Barcelona clinic, with physical examination. It includes the medical report for that visit.
- Video consultation, to assess a case, review reports or give a second opinion remotely. A final decision on surgery requires an in-person examination.
- Follow-up visit (a subsequent visit within the same care process).
- Diagnostic and pre-operative tests, when booked through the clinic.
- Surgical procedures, always under an individual written quote issued after medical assessment.
Medicine is an obligation of means: the medical team undertakes to act diligently and in line with good clinical practice, but cannot guarantee a specific result. Video consultations are not for emergencies: if you have serious symptoms, call 112 or go to A&E.
4. Booking online
To book online: 1) choose the service on the booking page; 2) pay through Stripe's secure checkout, which shows the amount before you confirm and lets you correct the details you have entered; 3) you will receive the payment receipt by email; 4) within 24 working hours, our coordination team will contact you to set the date and time. The clinic keeps a record of the transaction and you can ask us for a copy at any time.
5. Prices and taxes
Consultations have fixed prices: first in-person consultation, €120; follow-up visit, €70; video consultation, €50. All other prices published on the website are indicative ("from") and are confirmed in the written quote after the first in-person consultation. Published prices include applicable taxes.
Medical care for diagnostic or therapeutic purposes is exempt from VAT (article 20.One.3 of Spanish VAT Law 37/1992). Procedures without that purpose, such as cosmetic ones, carry the applicable VAT, shown separately in the quote and the invoice.
6. Payment methods, bookings and deposits
- Online payment through Stripe, by card or other methods Stripe offers at the time. InSurgical never sees or stores your card details.
- At the clinic, by card, or by bank transfer when agreed.
- Financing through external lenders (see the financing page). The loan is a contract between you and the lender; the clinic does not grant credit.
Consultations are paid in advance when booked. To reserve an operating theatre date or order materials, tests or medicines, the clinic may ask for a deposit, whose amount and due date are stated in the quote and which is always deducted from the total. After each payment you will receive a receipt and, where applicable, an invoice.
7. Appointments, changes and late arrival
An appointment is confirmed when the clinic sends you the date and time in writing (email, WhatsApp or text message). The only notice period in these terms, the one for surgical procedures (section 8), is counted from the moment you tell us about the change or cancellation until the start time of the procedure.
Rescheduling: consultations (first in-person consultation, video consultation and follow-up consultation) can be rescheduled whenever you like, without notice and at no cost. A surgical procedure can be rescheduled at no cost with at least 48 hours' notice; a change requested with less than 48 hours' notice is treated as a cancellation of the procedure with less than 48 hours' notice (section 8).
Late arrival: if you arrive late, we will see you in the remaining time without affecting other patients. If you are more than 15 minutes late and we cannot see you, we will give you another appointment at no cost. For video consultations, the same applies if you do not connect within 15 minutes of the scheduled time. If the delay is ours (for example, because the surgeon is dealing with an emergency), you can wait, reschedule free of charge or ask for a full refund.
How to notify us: by phone or WhatsApp on +34 639 301 352 or by email to info@insurgical.es. The date and time your message is sent counts, even outside clinic hours. We will confirm receipt in writing; please keep that confirmation.
8. Cancellation by you
You may cancel at any time. What happens to your payment depends on the service:
- Consultations (first in-person consultation, video consultation and follow-up consultation), medical tests, consumables and medicines: you can cancel or reschedule them at any time, without notice and at no cost. We refund in full what you paid or, if you prefer, apply it to a new date.
- Surgical procedures, with 48 hours' notice or more: we refund in full what you paid or, if you prefer, apply it to a new date.
- Surgical procedures, with less than 48 hours' notice or if you do not attend: only 10% of the surgical fee is retained, as compensation for reserving the operating theatre, the team and the time, which can no longer be offered to another patient. The remaining 90% of the fee is refunded or, if you prefer, applied to a new date. Everything else in the quote (tests, consumables, medicines and other items) is refunded in full.
The 10% is calculated only on the surgical fee shown in the quote, never on the total or on tests, consumables, medicines or other items. It is the only amount that can be retained for cancelling.
| Service | Cancellation with 48 h or more | Less than 48 h or no notice |
|---|---|---|
| Consultations (in person, video and follow-up) | 100% refund | 100% refund |
| Tests, consumables and medicines | 100% refund | 100% refund |
| Surgical fee | 100% refund | 90% refund (10% retained) |
| Other items in the procedure quote | 100% refund | 100% refund |
Services already provided are not a cancellation charge. If, when you cancel, tests have already been carried out or medicines already handed over to you, those services have already been provided and so are not refunded; this is not a penalty for cancelling (and, for health and safety reasons, a medicine that has been handed over cannot be returned). Anything not yet carried out or handed over is refunded in full.
Cases with no retention. The 10% of the surgical fee is not retained if the cancellation is due to force majeure or to your hospital admission or illness preventing you from attending, duly documented; in that case we will offer a new date or a full refund. Nor is it a cancellation by you if the medical team postpones the procedure because, after assessment or tests, it would not be safe to perform it: you are then refunded what you paid, except for tests already performed and medicines already handed over, which are services provided.
Your clinical decision is always free. You can withdraw your consent to a procedure at any time (section 14). These financial rules only compensate for reserving the operating theatre; they do not limit your right to decide.
9. How and when refunds are made
Refunds are made without undue delay and within 14 calendar days at most from receipt of your cancellation (or from the clinic's cancellation), to the same payment method you used, unless you expressly ask for another and it costs you nothing. Card payments are refunded to the same card through Stripe; depending on your bank, the credit may take a few more days to show in your account. If you financed the payment, the refund is processed with the lender under your loan agreement. You will receive the corresponding corrective invoice.
10. Cancellation or changes by the clinic
If the clinic has to cancel or postpone your appointment or procedure, we will tell you as soon as we know and you can choose between a new date or a full refund of everything paid, including unused tests, consumables and medicines. If the clinic cancels a procedure with less than 48 hours' notice for reasons attributable to it, we will also pay you an amount equal to 10% of the surgical fee, the same amount that would be retained from you in the opposite case. This compensation does not apply when the cancellation is due to force majeure or clinical safety reasons (for example, a medical emergency the surgeon must attend to or the lack of safe conditions in the operating theatre); in those cases you will be offered a new date or a full refund.
11. No-show
Missing a consultation (in person, video or follow-up) costs you nothing: we refund what you paid or give you another appointment, as you prefer. If you do not attend a surgical procedure without notifying us, it is treated as a cancellation with less than 48 hours' notice: only 10% of the surgical fee is retained, and the rest (90% of the fee and everything else in the quote) is refunded or, if you prefer, applied to a new date.
12. Quotes for procedures
Each procedure is quoted individually and in writing after medical assessment. The quote states what is included (for example, team fees, operating theatre, hospital stay, materials and post-operative check-ups) and what is not, VAT where applicable, how to pay and any deposit. It is valid for 30 calendar days from issue, unless it states otherwise.
If an unforeseen situation arises during surgery that requires extending it to protect your health, the team will act in line with good practice and with what you authorised in the informed consent. Any additional cost not included in the quote will be explained and justified to you; except in an emergency, it will not be charged without your prior agreement.
13. Right of withdrawal
Health services provided by a health professional to assess, maintain or restore a patient's state of health, including the prescription and provision of medicines and medical devices, are excluded from the rules on distance contracts (article 93(b) of the Spanish consolidated consumer protection law, Royal Legislative Decree 1/2007). Therefore the statutory 14-day right of withdrawal does not apply to these services. You can, however, cancel under section 8, which lets you recover everything you paid: always for consultations, tests, consumables and medicines, and for procedures if you give at least 48 hours' notice.
If you book at a distance (online or by phone) a service that is not a health service in that sense, you have 14 calendar days from booking to withdraw without giving a reason, by notifying us through any of the means in section 7; you may use this text if you wish: "I hereby give notice that I withdraw from the contract for the following service: [service], booked on [date], in the name of [full name]. Date and signature (only if sent on paper)". We will refund your payment within 14 calendar days at most, to the same payment method. If you expressly asked us to start the service within that period, you must pay for the part already provided, and you lose the right of withdrawal once the service has been fully performed (articles 103(a) and 108 of the same law).
14. Clinical information and informed consent
Before any surgery or invasive procedure you will receive adequate information about its purpose, nature, risks, consequences and alternatives, and you will be asked for your written consent, as required by Spanish Law 41/2002 on patient autonomy and Catalan Law 21/2000. You may ask any questions you need, take time to decide and freely withdraw your consent in writing at any time. You have the right to access your medical records and obtain copies of your reports.
15. Data protection
The controller of your data is Iván Díaz Cuadrado (InSurgical). Health data are processed to provide you with healthcare and manage your medical records, under article 9(2)(h) of Regulation (EU) 2016/679 and Spanish Organic Law 3/2018, and are kept for the periods required by health legislation. Online payments are processed by Stripe. Full information on purposes, recipients, retention and your rights is in the privacy policy (in Spanish); you can exercise your rights by writing to rgpd@insurgical.es.
16. Complaints
If you are not satisfied, please tell us first: info@insurgical.es, by phone or at the clinic. We will reply as soon as possible and, in any case, within one month.
The official complaint forms (fulls oficials de queixa, reclamació i denúncia) provided for in the Catalan Consumer Code (Law 22/2010) are available at the clinic. You may also contact your local consumer information office (OMIC) or the Catalan Consumer Agency (Agència Catalana del Consum), which can mediate. InSurgical is not a member of the consumer arbitration system. For matters of medical ethics, you may contact the Barcelona Medical Association. None of this limits your right to go to court.
17. Governing law and courts
These terms are governed by Spanish law and, where applicable, Catalan law. If you book as a consumer, the courts of your place of residence will have jurisdiction. If any clause is held void, the rest remain valid.
18. Changes to these terms
The clinic may update these terms due to legal changes or changes in its services. The applicable version is the one published when you booked: later changes do not affect services already paid for, unless they are more favourable to you. The date of the last update is shown at the end of this page.
